How to Appeal an Unemployment Denial

If your unemployment claim is denied, you have the right to appeal: federal law requires every state to offer a fair hearing before an impartial tribunal. The deadline and the way to file are in the determination letter your state sends, so read it right away and file before the date it gives.

Your right to a hearing

To receive federal funding, every state's unemployment law must provide an "opportunity for a fair hearing, before an impartial tribunal, for all individuals whose claims for unemployment compensation are denied" (42 U.S.C. 503(a)(3)).

How to appeal

  1. Read your determination letter as soon as it arrives. It explains why the claim was denied, the deadline and how to appeal.
  2. File the appeal the way the letter says (online, by mail or fax) before the deadline.
  3. Gather proof: pay stubs, separation letters, emails, work search records and names of witnesses.
  4. Attend the hearing on the date and in the format the notice gives.
